Terms & Conditions


Please read these terms and conditions (“T’s &C’s”) carefully. They apply to all sales within the United Kingdom of products by Dillions Estates LLP, a limited liability partnership registered in England and Wales with partnership number capital OC418079, VAT registered number: 335563202, AWRS number: XQAW 000 0011 4665 and with a registered office address of 3 East Pallant Chichester,  West Sussex, United Kingdom, PO19 1TR. 

Dillions Estates LLP trades as Dillions Vineyard from Dillions, Tanyard Lane, Staplefield, West Sussex RH17 6HH.

In these T's and C's, reference to “we”,  “us“,  the “firm” and “Dillions Vineyard” are references to Dillions Estates LLP.

Dillions Vineyard is a registered trademark of Dillions Estates LLP.

Also, in these T’s & C’s, references to “you”, “your “or the “Customer” are to the person placing an order for the purchase of products from Dillions Estates LLP.

You agree to be bound by these T's and C's by continuing to access this site and/or by placing an order for the purchase of products from Dillions Vineyard.

We reserve the right to modify these T’s & C’s at any time without notice and such modified terms will apply with immediate effect to all orders placed subsequently or not confirmed by us at that time.

 

1.         We may only sell alcohol to persons of legal age to purchase alcohol in their country of residence: in the United Kingdom that age is 18 and over. Access to our website is restricted to persons aged 18 and over.  In placing an order, you warrant that you are of legal age to purchase alcohol in your country of residence and that you are not buying alcohol for someone who is not of legal age to purchase alcohol in their country of residence.  We reserve the right to refuse to accept an order in our sole discretion if we have reason to believe that this condition is not satisfied. 

2.         When you use Dillions Vineyard's online store, we will ask you for your email address and telephone number (for delivery purposes) when you order.

3.         It is your responsibility to ensure that all information is accurate and complete for the purposes of placing and delivery of an order.

4.         Each order placed by a capital Customer shall be deemed an offer and shall be subject to acceptance by Dillions Vineyard by way of an email (a “Confirmation Email”) sent to you at the email address you provide in your online account.  Dillions Vineyard may refuse to accept an order for any reason and without giving any reason. Please note that an on-screen acknowledgement of an order does not constitute acceptance of that order. 

5.         We must receive payment of the whole of the price for the products that you order and for delivery before your order can be accepted. We accept payment by Stripe. Your credit card details are captured securely within Stripe.   At no time do our employees or any person within our firm see any details of your credit card.   If your payment is reversed, we may cancel your order and repossess any products we have shipped or delivered.

6.         The prices for our products are set out on our website and may change. While every effort is made to ensure the published price of the products is accurate, we cannot guarantee pricing will be correct in all circumstances or that all products will be available at all times. In the event of a pricing error, we will offer you the option of a completion of the order at the correct price, a replacement or a refund, at your sole discretion. We reserve the right, however, to withdraw any promotional offers at any time. All prices are in British pounds sterling and are inclusive of VAT unless otherwise stated. The cost of delivery will be as stated on our online store. Once payment has been made and your order accepted, title in the products will pass to you.

7.         If we are unable to accept or fulfil an order or if we cancel an order for any reason, we will promptly notify you and offer you a refund or, at our sole discretion, a replacement or alternative product which you will be free to accept or reject at your discretion . We will not be obliged to offer any additional compensation for disappointment suffered.

8.         In respect of all orders dispatched, the risk in the products shall pass to you immediately on delivery.  We will deliver the products ordered by you to the address you give us for delivery at the time you make your order at the Checkout. It should be your responsibility to ensure that someone is available to take delivery or that a secure location is specified in the delivery details at which the products may be left.  We will not be liable for any loss or damage suffered as a result of the carrying out delivery instructions given by you (or by you not giving any specific delivery instructions) and the products being subsequently lost or stolen.

9.         Any delivery dates supplied through the online store or following acceptance of an order are given in good faith and in the expectation that we will be able to fulfil them. Notwithstanding the foregoing, the Customer accepts that time is not of the essence and Dillions Vineyard shall be under no liability for loss, damage or expense suffered by the Customer or any third party arising from the failure of Dillions Vineyard (or its agents) to deliver on any specified date or time or place.

10.       Delivery will be made as soon as possible after your order is accepted (usually dispatched within 5 to 7 working days from the date the order is accepted). Please note that at those times of the year when a high volume of orders are being placed, e.g. Christmas, Easter etc, we cannot always guarantee delivery within the usual time frame.

11.       You have the right to cancel your order by notifying us at info@dillionsvineyard.co.uk within fourteen (14) days after the date we accept the order. However, we are only obliged to reimburse the cost of returning items where they were delivered in error, or the products were damaged or defective at the point of delivery.

12.       You cannot cancel your order if:

a.         the goods ordered have been opened by you or any seals broken; or

b.         the goods have been altered, marked or damaged by you in anyway.

13.       If you have received the products before you cancel your order then, unless under Clause 12 you do not have a right to cancel, you must send the products back to our contact address at your own cost and risk by no later than seven days after our delivery (or, if later, 14 days after the date we accept the order for return). If you cancel your order but we have already processed the products for delivery you must not unpack the products when they are received by you.  Time shall be of the essence and we shall not be obliged to accept any returns made after these dates or process any refunds in respect of such late returns.

14.       We shall not be obliged to give any refund if the products are not returned in their original condition, wrapping and packaging.

15.       We will provide a full refund or replacement for any products which are defective or not as described.  In such event, subject to Clause 19 below, you have a period of thirty (30) days, starting from the date of delivery of the order, to reject any product contained in the order.  This condition does not affect your statutory rights.


16.       Once you have notified us that you are cancelling your order, unless you are not entitled to cancel the order or to receive a refund, any sums paid to us by bank transfer or debited to us from your credit card will be re-credited to your account as soon as possible after the products in question have been returned by you and received by us in the condition they were in when delivered to you.  If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be we shall not be obliged to refund or re credit you.

17.       If you wish to exchange a product, additional shipping charges may apply together with the difference (if any) between the prices of the original and the replacement product. 

18.       The images, digital copies, descriptive matter and specifications of the goods contained on the online store are posted for the sole purpose of giving an approximate idea of the goods and you acknowledge that there may be differences.

19.       If the products we deliver or not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address or at info@dillionsvineyard.co.uk of the problem within three days of the delivery of the products.  In the absence of notification within three days of delivery, the products shall be deemed to have been delivered in accordance with your order.

20.       If you do not receive goods ordered by you within 21 days of the date on which we accepted your order, you should notify us within 14 days, failing which we shall have no liability to you. Our sole liability to you shall be, at our option, to make good the order or to provide you with a refund within 30 days of your notification.

21.       We shall have no liability to you for any failure to deliver products you have ordered or any delay in doing so or for any damage or defect to products delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, failures of ISP or telecommunications providers, failure of delivery company, war, riot, civil commotion, malicious damage, non-compliance with any laws or government order, rule, regulations or direction, flood, fire, storm, act of God, pandemics, lockdowns, explosions or accidents or acts of terrorism.

22.       Any implied warranties or conditions in respect to products or other services supplied by Dillions Vineyard, save only for those provided under the Sale of Goods Act 1979, are hereby expressly excluded and Dillions Vineyard shall not be liable for any loss, injury or damage arising directly from the use, application or storage of such products except where such liability cannot be limited in law. Save as precluded by law, we will not, in any circumstances, be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the products in question.

23.       The use of our website is at your own risk. This website is provided to you “as is”, without warranty of any kind, either express or implied. Neither Dillions Vineyard nor its partners, employees, agents, third-party information providers, merchants, licensor's or the like warrant that the website or its operation will be accurate, reliable, uninterrupted or error free. No agent or representative of Dillions Vineyard or otherwise has the authority to create any warranty regarding the website on behalf of Dillions Vineyard. Dillions Vineyard reserves the right to change or discontinue at any time any aspect or feature of our website.

24.       The content of the pages of our website is for general information and use only. It is subject to change without notice.  Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose.  You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. 

25.       Notwithstanding the foregoing, nothing in these T’s & C’s is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

26.       Please consume alcohol in moderation and be aware that sparkling wines can be volatile due to the build-up of gas: extra care should be taken when uncorking, including angling the bottle away from the face, eyes and other people.

27.       Unless otherwise expressly stated in these T’s & C’s, all notices from you to us must be in writing and sent to our trading address at Dillions Estates LLP, Dillions, Tanyard Lane, Staplefield, West Sussex RH17 6HH.

28.       Any variation of these T's & C's requested by you shall only be effective if in writing and acknowledged in writing by Dillions Vineyard.

29.       Each of these provisions of these T's & C's is severable and distinct from the others and if at any time any one or more of such provisions is or becomes invalid, illegal or unenforceable in any respect under any law, the validity common legality and enforceability of the remaining provisions shall not be in anyway affected or impaired thereby.

30.       We adhere to the procedures set out in the UK Data Protection Act 1998 and to the terms of GDPR in the storage and disclosure of any data to prevent unauthorised access.  Your information will be used to process orders and for the use of marketing, as set out in our Privacy and Cookie Policy.

 31.       All of the copyright in the products and designs, material, documents, site design, graphics, systems, codes and connections contained on our Website or linked to it and the selection and arrangement thereof are owned by or licenced to us, the Website designers or the publishers of those sites to which this Website links.   All rights are reserved.  You are entitled electronically to copy and to print in hard copy sections of this Website for the sole purpose of placing an order with us or for viewing our product range and not for any other purpose.  Any other use of material on this Website, including photocopying, modifying and or distributing any pages printed off this Website for the purposes other than those noted above, without our prior written consent, is strictly prohibited.

32.       From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

33.       Except for our partners, employees or  representatives, a person who is not a party to these T's & C's has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of these T’s & C’s but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

34.       These T’s & C’s and any order or contract between us to which these T’s & C’s apply shall be governed by and interpreted in accordance with English law.  You and Dillions Vineyard submit to the exclusive jurisdiction of the courts of England and Wales as regards any claim, dispute or matter (whether contractual or non-contractual) arising out of or in connexion with these T’s & C’s and any agreement relating to the supply of products to you by us.

35.       These T’s & C’s, together with our online store prices, delivery details, contact details and Privacy Policy, set out the whole of our agreement relating to the supply of the products to you by us.
